For residential land disturbance permits, payment must be submitted with a completed Agreement In Lieu Of form and a site grading plan, if applicable.

Due to copy costs, the department does not provide copies of state erosion and sediment control regulations or the local ordinance. Please download documents and complete. Most forms are fillable. (An updated version of Adobe Reader may be required.) 

The following documents should be utilized when developing an individual single-family dwelling. For residential subdivisions please refer to commercial land disturbance.

What is soil erosion?

Soil erosion is the wearing away of the land surface (including detachment and movement of soil particles) by running water, wind, ice, and gravity.  Frederick County’s Erosion and Sediment Control (ESC) Program primarily deals with erosion resulting from water (raindrop impact and surface runoff) on un-stabilized soil during the construction process.

How is a land disturbance permit issued for individual single-family dwelling construction?
Land disturbance for Individual single-family dwelling construction is permitted through the building permit process.  Homebuilders will be required to complete and sign an agreement-in-lieu of an erosion and sediment control plan prior to beginning any land disturbing activities.
How do I schedule a preliminary E&S inspection?

Please call Building Inspections at 540-665-5650 to schedule an inspection.

When is an individual residential lot considered to be stabilized?

As defined in the Frederick County code, when the lot has achieved final stabilization as described above or by “the homebuilder establishing temporary stabilization, including perimeter controls for an individual lot prior to occupation of the home by the homeowner, and informing the homeowner of the need for, and benefits of, final stabilization.”
